HOLP GmbH (hereinafter "HOLP") stands for the quality of its products and the satisfaction of its customers. In order to substantiate this claim and the trust of our customers, HOLP guarantees the end customer, who can only be an entrepreneur within the meaning of Section 14 German Civil Code (BGB) (hereinafter "customer") in accordance with the following provisions, that products delivered to the customer (hereinafter "Products") within a period of one (1) year from delivery to the customer will be free of defects ("warranty defects"), wherein in the case of the RotoTop the warranty period for tooth and/or housing breakage is three (3) years or 3,000 hours from delivery, depending on which period is earlier. The guarantee shall only apply to RotoTop, however, only if the operation is carried out with standard attachments for the respective excavator size. The use of models in combination with an excavator size not approved for this model will result in the loss of the warranty. The use of bigger attachments especially milling, vibrating plates or hammers must be confirmed in writing by HOLP in advance.

The defects covered by this warranty will be fixed by HOLP at its own discretion and at its expense by repairing or supplying new or refurbished parts. The guarantee is limited to warranty defects, in particular not to faults in hydraulic components, such as hydraulic motor couplings, rotary feedthrough or seals. The quick-hitch changer is not covered by the HOLP guarantee; therefore, the warranty determination of the respective manufacturer applies. Other claims of the customer against HOLP, in particular for damages, are excluded. However, the contractual or legal rights of the customer to HOLP are not affected by this guarantee.

Claims under this guarantee shall only exist if

  • the product does not have any damage or signs of wear caused by a use deviating from the normal determination and the specifications of HOLP (in accordance with the user manual) (in particular by driving the machine when the spoon is in the one-handle, through putting the excavator on-the-shaft to increase the break-off torque, by improper working with the pivot arm or by an overhanging excavator supporting itself with force on the attachment, by using adulterated oil (e.g. mineral or ester oil) or too high pressure);
  • the product does not have any characteristics that result from repairs or other interventions by HOLP unauthorized workshops,
  • in das Produkt nur von HOLP autorisiertes Zubehör eingebaut wurde,
  • the fabrication number has not been removed or un-marked.

Claims under this guarantee require that the customer contact the factory customer service before sending the product and has given him the opportunity to conduct a telephone error analysis within a period of three (3) working days. Claims under the guarantee can then only be claimed by handing over or sending the product to the repair centre referred to by the customer service. The condition of the warranty claim is still the original invoice with the date of purchase. The cost of sending and returning the product takes over HOLP. However, if the customer service responsible has called the customer a specific carrier for the submission and the customer uses another carrier, HOLP will not be charged for the cost of the submission.

If warranty claims are asserted and if the product is inspected by HOLP or the relevant customer service that no error has occurred or the warranty claim does not exist for any of the reasons mentioned above, HOLP is entitled to Service fee in the amount of the prices valid at HOLP (Stand 01.2018: Field Service 75.-€/hour plus mileage of €1.20/hour as well as for repairs at Plant 65,-€/hour) plus VAT. The relevant legal level. This does not apply if the customer proves that he was unable to recognize the circumstances in which the warranty claim did not exist.

This guarantee shall apply to the aforementioned extent and under the aforementioned conditions (including the presentation of the purchase order, also in the case of resale) for any future owner of the product.

This guarantee is subject to the laws of the Federal Republic of Germany. The place of performance and exclusive jurisdiction for all disputes arising out of or in connection with the guarantee is Murrhardt.

This Declaration is executed in the German and English languages. In the event of any inconsistencies, the German version shall prevail.
